Notice of the China (Shanghai) Pilot Free Trade Zone on the Registration Permit of Customs Declaration Enterprise (Cross-Customs Branch)

I. Operation Basis
Customs Law of the People’s Republic of China, Customs Measures of the People’s Republic of China for Implementation of the Administrative License Law of the People’s Republic of China, Regulations on Registration Administration of Customs Declaration Units by the Customs
II. Scope of Application
The applicant files an application to Customs, and the local Customs declaration enterprises or the cross-Customs branches of other Customs declaration enterprises obtain the administrative license items relating to the Customs registration.
III. Required Materials
The Customs declaration enterprise applicants shall submit the following documents (with the original submitted to Customs for verification, and with the photocopies to be prepared in duplicate):
1. Application for Registration License of the Customs Enterprises;
2. Duplicate of the Business License for Legal Entity or the photocopy of the Notice of Pre-approval of Corporate Name;
3. Photocopy of the duplicate of the Organizational Code Certificate;
4. AoA of the enterprise;
5. Photocopy of the contribution certificate;
6. Photocopy of the Customs Declarer Qualification Certificate of the Customs employee as employed;
7. Feasibility Research Report on the Customs Declaration Service Business;
8. Work Resume of the person in charge of the Customs declaration business;
9. Certificate of the ownership of the Customs declaration operation place, and lease certificate;
10. The foreign invested enterprises shall submit the Certificate of Approval for Establishment of Enterprises with Foreign Investment in the People’s Republic of China (to be submitted upon handling of the registration formalities);
11. International forwarding agent enterprises shall submit the photocopy of the Filing of International Forwarding Agent Enterprises (to be submitted when handling the registration formalities);
12. Other materials relating to application for the registration license.
IV. Application Process
The applicant may type the application information through the pre-typing organization or by logging on to the online corporate management platform of Customs via the Internet, and file an application to Customs in the place where the enterprise is registered (based on the industrial and commercial registration place). For the registration of new enterprises, the application shall be filed only through the pre-input mechanism; meanwhile, relevant documents and materials are submitted toCustoms where the registration is made, for the purpose of review;
The application and relevant materials as submitted by the Customs applicant where the registration is located; makes the decision on whether it is accepted within five days after submission of the application by the applicant, and prepares and issues the decision whether it is accepted;
If the application materials are incomplete or not in conformity with the legal form, Customs shall notify the applicant of all contents to be made up or corrected;
Shanghai Customs makes the decision on whether the administrative license for registration of the Customs declaration enterprises (cross-Customs branches) is approved, and the local Customs shall submit the administrative license to the applicant;
The applicant shall handle the registration of operation items at the industrial and commercial administration after receipt of the Decision on Approval of the Registration License of Customs Declaration Enterprises (Cross-Customs Branches) from Customs, and shall, within 90 days from the day upon the registration at the industrial and commercial administration, handle the registration formalities at Customs where the registration is located;
Customs shall, after handling the formalities for registration of Customs declaration enterprises (cross-Customs branches), verify and issue the Certificate of Registration of Customs Declaration Enterprises of the People’s Republic of China.
